11. Legal Basis for the Processing

GDPR or country-specific data protection regulations applicable to KBC set out the legal basis for processing personal data for which we obtain consent for a specific processing purpose. Processing of personal data may be necessary for contract purposes for example, for the supply of goods or to provide any other service. The same applies to such processing operations which are necessary for carrying out pre-contractual measures, for example in the case of inquiries concerning our products or services. KBC is subject to a legal obligation by which processing of personal data is required, such as for the fulfilment of tax obligations. In rare cases, the processing of personal data may be necessary to protect the vital interests of you or of another natural person. This would be the case, for example, if a visitor were injured in our company and their name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party. Finally, processing operations, which are not covered by any of the abovementioned legal grounds, may be necessary for the purposes of the legitimate interests pursued by KBC, except where such interests are overridden by your interests or fundamental rights and freedoms which require protection of personal data. Such processing operations are particularly permissible because they have been specifically mentioned and in accordance with the country-specific data protection regulations applicable to KBC. It is considered that a legitimate interest could be assumed if you or your employer are a client of KBC.

12. The Legitimate Interests Pursued by KBC

The processing of personal data to carry out our business in favour of the well-being of all our employees is considered a “Legitimate Interest Pursued by KBC.”

13. Period for Which the Personal Data will be Stored

The criteria used to determine the period of storage of personal data is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfilment of a contract or the initiation of a contract.

14. Cross-Border Transfer

Our services are global and data (including personal data) may be stored and processed in any country where we have operations or where we engage service providers. We may transfer data to countries outside of your country of residence, which may have data protection rules that are different from those of your country. However, we will ensure that any such transfers comply with applicable data protection laws and that your data remains protected to the standards described in this privacy policy. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your personal data for legal requirements.

15. Provision of Personal Data as Statutory or Contractual Requirement

The provision of personal data is partly required by law (e.g. tax regulations) or can also result from contractual provisions (e.g. information on the contractual partner). Sometimes it may be necessary to conclude a contract with personal data provided by you, which must subsequently be processed by us. You are, for example, obliged to provide us with personal data when our company signs a contract with you. The non-provision of personal data may have the consequence that the contract with you could not be concluded.

16. Existence of Automated Decision-Making

We do not use automatic decision-making or profiling.

17. Purpose of KBC’s Website

We adopt the above policy because we assume that as a visitor to our site, you have a professional interest in the products and services you explore.
